Terms of Service
These Terms of Service (the “Terms”) are a binding agreement between you (“Customer”, “you”) and [LEGAL NAME], a company registered in [JURISDICTION] under number [COMPANY ID / IČO], with its registered office at [REGISTERED ADDRESS] (“consostack”, “we”, “us”). They govern your access to and use of the consostack platform, websites, APIs, MCP endpoint, dashboard, and related services (together, the “Service”). By creating an account, ordering, or otherwise using the Service, you agree to these Terms.
1The Service
consostack is an AI-native hosting platform. It lets you deploy web applications from a public git repository or a provided template, provisions managed databases (PostgreSQL, Redis, SQLite), issues HTTPS certificates, and serves your applications on a subdomain or a custom domain. The Service can be operated conversationally through an AI assistant over the Model Context Protocol (MCP), programmatically through a REST API, and visually through a web console.
Applications run in isolated containers on compute infrastructure located in the European Union. We may update, add, or remove features over time.
2Eligibility & accounts
You must be at least 18 years old and able to form a binding contract. You may create an account directly (email, name, password) or have one provisioned automatically the first time you deploy. You are responsible for the accuracy of your account information, for all activity under your account and API keys, and for keeping your credentials confidential. 3Plans, fees & billing
The Service is offered in tiers (Free, Pro, Team, Enterprise) with the limits and prices shown on our pricing page. Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. Prices are exclusive of taxes unless stated; you are responsible for applicable taxes. Plan limits are enforced; exceeding them requires an upgrade.
Refunds
Except where required by law, fees are non-refundable. [STATE YOUR REFUND POLICY — e.g., 7-day money-back on first paid month]. You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period.
4Preview status
The Service is currently offered as a preview. Pricing is indicative, some features are still being hardened, and paid billing may not yet be active. The Service is provided during preview on an “as is” and “as available” basis, without any service-level commitment (see the SLA). Do not rely on the preview Service for workloads whose failure could cause material harm.
5Your content & responsibilities
“Customer Content” means the code, data, environment variables, domains, and other materials you deploy or store through the Service. You retain all rights to your Customer Content. You grant us a limited licence to host, copy, transmit, build, and display Customer Content solely to operate and provide the Service.
You are solely responsible for your Customer Content and for your applications, including their security, legality, and any data they process. You are responsible for maintaining your own backups; while we take reasonable operational measures, the Service is not a backup service.
6Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms. Violations may result in suspension or termination under Section 9.
7Third-party services
The Service integrates third parties including, without limitation, our infrastructure provider ([INFRASTRUCTURE PROVIDER, e.g., Hetzner Online GmbH]), our payment processor (Stripe), and certificate authorities (e.g., Let's Encrypt). Your use of those components may be subject to their terms. We are not responsible for third-party services outside our control.
8Intellectual property
The Service, including its software, design, and trademarks (“consostack” and associated marks), is owned by us or our licensors and is protected by intellectual-property laws. These Terms grant you no rights in our intellectual property except the limited right to use the Service in accordance with these Terms. Any feedback you provide may be used by us without restriction.
9Suspension & termination
We may suspend or terminate your access, in whole or in part, if you breach these Terms or the AUP, if required by law, to protect the Service or other users, or for non-payment. Where practicable we will give notice. You may stop using the Service and close your account at any time. On termination, your right to use the Service ends and we may delete Customer Content after a reasonable period; export your data beforehand.
10Warranties & disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your requirements.
11Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our aggregate liability arising out of or relating to the Service will not exceed the greater of [e.g., the amounts you paid us in the 3 months before the claim] or [e.g., €100]. Nothing in these Terms limits liability that cannot be limited under applicable law.
12Indemnification
You will defend, indemnify, and hold us harmless from claims, damages, and costs (including reasonable legal fees) arising out of your Customer Content, your applications, or your breach of these Terms or the AUP, except to the extent caused by us.
13Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or a notice in the Service). Your continued use after changes take effect constitutes acceptance of the updated Terms.
14Governing law
These Terms are governed by the laws of [GOVERNING LAW], without regard to conflict of law rules. The courts of [JURISDICTION / VENUE] have exclusive jurisdiction, except where mandatory consumer-protection law provides otherwise.
